LEASE AND ACCEPTANCE OE LEASE OE LAND AT BANDER
SHWAIKH, 1907.
No. 5 (a).
Translation of lease of the Shwaikh lands.
In the name oe God, the Exalted !
I bis agreement is from me, Shaikh Mubarak-us-Subah, ruler of Kuwait, on
behalf of myself and on behalf of my heirs after me, to Major S. G. Knox, Politi
cal Agent of the precious Imperial English Government in Kuwait, on behalf of
the precious Imperial English Government. The reason of writing this paper is
that I, Shaikh Mubarak-us-Subah, the ruler of Kuwait, have, on behalf of myself
and on behalf of my heirs after me, leased in perpetuity to the precious
Imperial English Government the land, of which the boundaries are detailed
below and south of Bander Shwaikh :—
Firstly .—The boundary of the land on the north-west shall be 7,500 cubits
in length in a straight line and situated in it the coal-house which I, Shaikh
Mubarak-us-Subah, have constructed in these days in the aforesaid land and the
straight line shall march, as far as possible, corresponding with sea-line but,
apart from these two conditions, it shall be lawful to Major S. G. Knox,
Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. , Kuwait, or to any other person, duly authorised on behalf of the
precious Imperial English Government, to draw this direct north-western
boundary at their choice and pleasure, and such boundary shall be accepted by
me, Shaikh Mubarak-us-Subah, ruler of Kuwait, on behalf of myself and on
behalf of my heirs after me. •
“ And secondly (as to) the eastern side and the western side, the length
of each side (shall be) six hundred cubits, and the southern side seven thousand
and five hundred cubits, and the whole land (shall be) rectangular; and from
this land, there shall come from it to me, Shaikh Mubarak-us-Subah, ruler of
Kuwait, and to my heirs after me, a piece from the north side on which shall
be the coal-house abovementioned; on the four sides the length of each side
shall be three hundred cubits, the whole amounting to a thousand and two
hundred cubits, exclusive of the measurement of the house and (the space)
opposite this piece, on the north, shall be to me, Shaikh Muharak-us-Subah,
ruler of Kuwait, and to my heirs after me.”
Secondly .—The rent of the land aforesaid shall be counted at R4 per cubit
yearly which shall flow from the day that this paper, duly agreed, signed
and sealed, shall pass between the hands of the two parties and the rent shall
be paid yearly in advance.
Thirdly .—In explanation of the preceding paragraph, the aforesaid^ lands
are embraced by one line, the length of which is 16,200 cubits. Exclusive of
the dimensions of the plot of ground of 1,200 cubits, reserved by this agree
ment to me, Shaikh Mubarak-us-Subah, ruler of Kuwait, and to my heirs after me,
the remainder is 15,000 cnbits and the rent of the land, according to this line,
amounts to R60,000, which shall be paid yearly in advance to me, Shaikh Mubarak-
us-Subah, ruler of Kuwait, and to my heirs after me, as long as the precious
Imperial English Government desires the lands aforesaid. But it is clearly under
stood and agreed upon between me, Shaikh Mubarak-us-Subah, ruler of Kuwait,
on behalf of myself and on behalf of my heirs after me, and Major S. G. Knox,
Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. of the precious Imperial English Government in Kuwait, ^ on
behalf of the precious Imperial English Government, that should the precious
Imperial English Government no longer desire to lease the lands aforesaid, they
have the right to inform me, Shaikh Mubarak-us-Subah, or my heirs after me,
of their decision at any time they wish and that, after such intimation, the rent
ceases, and the land will return to me, Shaikh Mubarak-us-Subah, or to my heirs
after me, but, if the Government should have any desire in land, other than
the lands of Shwaikh, as the lands enumerated in the sixth paragraph below, it
will be by way of rent by consent with me, Shaikh Mubarak-us-Subah, or my
heirs after me.
