of and arTministers or otherwise deals with, any part of
the property of the deceased, her shall, as soon as practicable,
notify' the fact and the circnmstances to the District Court, and
ehall furnish to the Court all such information as the Court re
quires, aM shall conform to any direction of the Court in rela
tion to the custody, disposal, or transmission of the property
©r the proceeds thereof, and, in case of any contravention of this.
Article, he shall be punished with a fine, which may extend to
1,000 rupees Indian silver coin also widely used in the Persian Gulf. .
42.—(1) When the peculiar circumstances of the case appear
to the District Court so to require, for reasons recorded in its pro
ceedings, the Court may, if it thinks fit, of its own motion or other
wise, grant letters of admini&tratiofi to an Officer of the Court.
(2) The Officer so appointed shall act under the direction of
the Court, and sl^all be indemnified thereby.
(3) He shall publish such notices, if any, as the Court thinks
fit, in Kuwait, the Persian Coast and Islands, Bombay, the United
Kingdom^ and elsewhere.
. (4); The Court shall require and compel him to file in the pro
per Office of the Court, his accounts of his administration at in
tervals not exceeding three, months, and shall forthwith examine
them and report thereon to the Chief Court.
(5) The accounts stall te atidited under the direction of the

(6) All expenses incurred on .behalf of the Court in execution
of this article shall be the first charge on the estate of the deceased
as dealt with in accordance with the provisions of this Order ; and
the Court shall, by the sale of that estate or otherwise, provide for
the discharge of those expenses.
43. In cases where parties are Muhammadans the District
Court may refer any question concerning probate of wills or ad
ministration of property of deceased persons to whom this Order
applies to a Qazi for settlement under the general supervision of
the Court.
Part V.—Kuwait akd Foreign Supjects and Tribunals.
(a) Criminal.
44 . (l) When any person not subject to this Order desires
to institute a complaint against a person to whom the said Order
applies, the Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. shall entertain the same, and shall
(a) himself hear and determine it in his District Court, or (6) if both
parties are Muhammc dans, refer it with their consent, to a Qazi
for decision, sending a representative of the Agency An office of the East India Company and, later, of the British Raj, headed by an agent. to record
briefly the proceedings. Such decision, when endorsed by the
Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. , shall for all purposes be considered as if it were
that of the District Court.
(2) Provided that the Kuwait subject or person not subject
to this Order, if so required by the Court, first obtains and files
in the proper Office of the Court the consent, in writing, of the
competent authority (if any) on behalf of his own nation to his
submitting, and that he does submit by writing, to the jurisdiction
of the Court, and, if required by the Court, gives security to the
satisfaction of the Court, and to such reasonable amount as the
.Court thinks fit, by deposit or otherwise, to pay fees, costs, and
damages, and abide by and perform the decision to be given by the
Court or on appeal.
(3) A cross suit shall not be brought in the Court against
the plaintiff, being a person not subject to this Order.
(4) When a person to whom this Order applies desires to
institute a complaint against a person not subject to the said
Order, who is a subject either of the Shaikh or of some other
Muslim Power not represented by a Consular Official in Kuwait,

Papers relating to the composition, drafting and publication of The Kuwait Order in Council A regulation issued by the sovereign of the United Kingdom on the advice of the Privy Council. , 1925 (His Majesty's Stationery Office, 1925). The volume includes papers relating to initial objections and subsequent agreement on the part of Sheikh Ahmad al-Jabir as-Subah [Sheikh Ahmad al-Jabir Al Sabah], the ruler of Kuwait, to the exercise by the representative of the British Government of jurisdiction over the subjects and protected persons of all non-Muslim foreign governments in Kuwait, including a letter of agreement from the Sheikh written in Arabic, November - December 1925; Rules of Court relating to fees, October 1926; papers relating to the registration of British subjects in Kuwait, November 1925 - December 1926; and papers relating to the regularisation of the position of American missionaries in Kuwait, so that, if the need arose, they would be entitled to British protection, February - December 1928.

Arrangement

The papers are arranged in approximately chronological order from the front to the rear of the volume.

Physical characteristics

Foliation: the foliation system in use commences on the title page and continues to the last folio that bears any text (seven folios from the end of the volume). The sequence appears written in pencil, enclosed in a circle, in the top right hand recto The front of a sheet of paper or leaf, often abbreviated to 'r'. page of each folio. Foliation anomalies: folio 1 is followed by folios 1A, 1B and 1C. Folio 186 needs to be folded out in order to be read. A second sequence also appears, again written in pencil in the top right hand corner of most of the folios, but not enclosed within a circle. This appears to start at [3] on folio 4 and continues to 287 on folio 254. This sequence marks all pages bearing text.
