We have the honour to refer to your latter
Mo*45606/1923 of 16th October last in which you informed
us that the Political Resident A senior ranking political representative (equivalent to a Consul General) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Residency. in the Persian Gulf The historical term used to describe the body of water between the Arabian Peninsula and Iran. would
be instructed to render assistance to our representat iTe
in negotiating an agreement with the Sheikh of Kowait.
The discussion between them has given rise to the question
of the period for which we shall enjoy the right of
exploitation. We think you will agree that it is
essential to fix this now, and the period we suggest in 60
years.
It would also seem desirable, in view of possible
tribal or other disturbances, to insert e 'force majeure*
clause in the agreement with the Sheikh, to the affect that
if the company , s work is delayed by events not within the
company's control then (1) the period of such delay shall
be added to the periods of the exploration and prospecting
licences, and to the period for which the royalty of
Rs.3.8.0. per ton is to hold goodj and (2) the fixed rent of
Hs. 30*000 shall not be payable in respect of the period of
such delay.
If you see no objection to these proposal® we
shall be obliged if the Resident may be so instructed.
