It is hardly necesaary to labour the argument t. ^ - - - - -
that in undeveloped communities *oonoiliation' is the only
means of effecting a permanent settlement,esreoially in
family quarrels and quarrels in which local customs are in
question.
The advisability of Conciliation' before judicial proceed
ings is recognised in the Order (vide Section 10), and it
is most desirable that provision should be made for similar
'conciliation* subsequent to the institution of judicial
proceedings•
This could be done by inserting a section after Section 14
following the lines of the Frontier Grimes Regulation.
I have not got a copy of the F.C.R. here,and am therefore
unable to suggest the wording,but the Council of Elders
would become a special Majlis.
(b). The rules for compounding offences (Section 345 of
the G.O.P.) are not entirely suitable to Bahrain,for
the
instmnce grievious hurt is non-compoundable,and eventless
of a tooth is held to be grievious hurt. A settlement
effected by 'conciliation' even after a fight in which
serious damage has taken place is much more likely to be
lasting than a regular settlement in Court by which a
fine or imprisonment is inflicted . I am under the impres
sion that this unsuitability of regular law to unsophisti
cated communities Is -nrovided for in the F.G.R.: in any
case both theft and "grievious hurt,to say nothing of murdrr
are,in practice,compounded in the N.W.F.P.,Baluchistan and
parts of Panjab. Were a provision made for the reference
cf disputes to arbitrators or a Council of Elders
'conciliation' could be effected without any special pro
vision regarding compounding.

Section 35 (l)
I believe that the powers of a District Judge in Bombay
are upto 5000./-, but do not know if this is in accordance
with rules made by the High Court. It is necessary to
