special agreement between the parties to submit the case to

that His Majesty's Government are bound to carry out
decisions in cases voluntarily submitted to the Court. But
they are also precluded by long standing engagements to the
Sheikh ox Bahrein, and by their own interests and regard for
theii reputation j.or good faith, from carrying out a decision
that Bahrein should be surrendered to Persia. It seems clear,
therefore, that His Majesty's Government ought to avoid talcing
any risk, (however negligible it may appear) of placing
themselves in a position in which they would be faced by an
insoluble conflict of obligations. For this reason he suggests
that the first alternative must in any event be ruled out.
In either of the other alternatives the Council
would still have to arrive at its own conclusion after either
asking the Court for an advisory opinion or seeking/the advice
of a committee of jurists. It seems highly improbable that
the Council, which would naturally take account of political
as well as other considerations, would arrive at a unanimous
conclusion in favour of Persia. Even in this most unlikely
ovent, however, it appears that the consequences under the
relevant articles of the Covenant would be far less serious
"than that of an actual judicial, and undoubtedly binding,
decision by the International Court in favour of Persia on a
case voluntarily submitted, to its jurisdiction. But the

A detailed Historical Memorandum of Bahrain compiled by the India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. is contained on ff. 94-118. The memorandum contains a history of Bahrain from the pre-1783 era until 1934 and includes details of the British role in the country, the numerous treaties signed by the Al Khalifa family with the British and a discussion of Turkish (Ottoman) and Persian claims to the territory.

Only pages with typescript are paginated. When both sides have typescript, pagination numbers are found only on even-numbered pages. There are two foliation errors: between f 14 and f 16 we have f 15A and f 15 B; between f 68 and f 70 we have f 69A and f 69B.
