cerned the present dispute at all as he asserted that pay
ment had been made on the original order placed by Yousuf
Pakhroo, whoa he eeeaaed was a different firm from Ahmad
VO*.
Fakhroo;end also pointed out that he £* not really estpoweroi
by his clients to deal with this case. as regards the
former pointy the arbitrator ruled that in accordance with
local commercial custody Messrs. lousuf K&khroo and Aiiaad
Fakhroo must be considered as one firr.i. The case was •
therefore discussed. Ahmad Fakhroo claimed that the 1200
tins of Margarlre gh*e despatched by 3uleman Yersi were not
up to the standard set out in the contract. According to
the t?rms of the Montract this ghee was edible and strongly
recommended by the consignors and also a certificate from
the Government Laboratoryy Nairobi * was included. Ahmad
FaKhroo also produced Messrs. Hussein Memah and Dhajaanaal
Issardasy who had received similar consignments at the same
time. They stated that the quality of the ghee they re
ceived was very poor ara$ they had had to sell it to a soap-
making firm. However it should be noted that these two
latter werchants appeared to accept it as a trading loss.
4. As no reconciliation between the two parties was pos-
slble, the arbitrator ruled th£t Messrs. Ahaad Pakhroo were
not able to, establish a breach of contract regarding this
stcond case a&d in view of the fact that the conditions of
j
the contract were loosely expressed and the Gov rodent Chemist's
analysis from Nairobi admits th&t tr e ghee was net a fine
quality one. The arbitrator therefore announced that in
the first case regarding 28 barrels of ghee, the agreement
already reached should stand and that no case lies in respect
of the consignment of 1200 tins of Mar^erine ghee.
