I am directed by the Secretary of State lor India in Council to
forward, for the consideration of the Earl of Kimberley, copy of a
letter,* dated 25th April last, from
the Government of India, giving
cover to correspondence regarding an application from Her Majesty’s
Consul-General at Bangkok for the refund of a sum of Its. 145 expended
in deporting two Burmese prisoners, convicted and sentenced by the
Consular Court there to imprisonment in India under the Siam Order
in Council. The Government of India demur to the charge being
recovered from Indian revenues, and ask for instructions.
2. I am to inquire if the Foreign Office can furnish Mr. Fowler with
any precedents or rulings in analogous cases which may serve as a
guide, and if he may be favoured with the reasons on which the Foreign
Office found the opinion that the expense may reasonably be expected
to be borne by the Government of India.

I laid before the Earl of Kimberley your letter of the 22nd
ultimo, inquiring as to the grounds upon wdiich Her Majesty’s Consul-
General at Bangkok had applied to the Government of India for the
refund of the expenses incurred by him in deporting two Burmese
prisoners, sentenced by the Consular Court there to imprisonment in
India, and asking for precedents as to the previous practice in analogous
cases.
I am directed by His Lordship to explain in reply that Mr. Scott
applied to the Government of India in this case in accordance with
Clause 12 of the Instructions to Her Majesty’s Consul-General, in
giving effect to the Siam Order in Council A regulation issued by the sovereign of the United Kingdom on the advice of the Privy Council. , 1889, wdiich states that
“ It is the desire of Her Majesty’s Government that expenses incurred
“ under this Order, on account of persons born or domiciled in British
“ Colonies or Possessions abroad should, when not paid by the persons
“ themselves, be, so far as is practicable, defrayed by the Governments
“ of the Colonies or Possessions to which the persons belong. Officers
“ administering the Order should bear this desire in mind in determining
“ not merely the place of deportation, but that of the trial and punish
ment of the persons in question.” A copy of the Instructions is
enclosed for convenience of reference.
