I have the honour to refer to the correspondence ending with Foreign
Department letter No. 1-G., dated 16th November 1909, enclosing a preli
minary diaft of the proposed
Order in Council

2. With concurrence of the Foreign Department, the subject was held
oyer pending my return for leave in the Spring and subsequently the dissec
tion of the draft disclosed so many points requiring full discussion between the

and myself that a great deal of time has necessarilv been
expended and I am only now able to submit the result to Government for
favour of further scrutiny. It comprises the joint views of myself
Captain Mackenzie and Major Prideaux, who, as Agent at Bahrein from 1904
to 1909, has been chiefly and creditably identified with the marked consolida
tion of our position winch has taken place since the presentation of the Ulti
matum to Sheikh Esa in February 1905.

but 1 trust that I am not mistaken in thinking that in forwardino > the draft
for comment the Government of India realised that considerable modifications
might be necessary in order to meet peculiar local conditions ; and in that belief
I have ventured to regard the draft rather as having been sent us as a working
basis than as a definite assertion of the views of Government, even in regard to
fundamental points. °
4. As regards most of the alterations suggested, I beg that the annotated
copy now submitted with this letter may be accepted as in itself supplvin"- the
needful explanation of our views in points of detail. There are certain primary
questions however which it is necessary that I should touch upon here
including the two subjects specially referred to in the Foreign Department
communication above mentioned, namely, the question of the position of
foreigners as regards jurisdiction under the order, and the need for Registration.
5. In the Foreign Department draft the definition of “Foreigner” was
