3 . The Principal Order shall have effect as if—
{a) in subsection (2) of section 15, the words " laws made by the
legislature of the Colony " were substituted for the words “ taws
enacted by the Governor under this Order
(6) in section 16, the words “ or any law made by the legislature of
the Colony ” were substituted for the words “ or any law made by
the Governor under this Order
(c) in subsection (6) of section 20, the words “ the legislature of the
Colony may, by law ” were substituted for the words “ the Governor
may, by law made under this Order ' ’.
Part II
LEGISLATIVE COUNCIL
4 . —(1) There shall be a Legislative Council in and for the Colony,
constituted in accordance with the provisions of this Order.
(2) The Council shall consist of the Governor as President, four
ex officio Members, not more than four Official Members and not more
than eight Unofficial Members.
5 . The ex officio Members shall be the Senior Officer for the time being
in and stationed in the Colony in command of His Majesty’s Regular
Forces therein (excluding the Governor or Officer Administering the
Government of the Colony) and the persons for the time being lawfully
discharging the functions of the respective offices of Chief Secretary,
Attorney General and Financial Secretary of the Colony.
6. The Official Members shall be persons holding office of emolument
under the Crown in the Colony, and, subject to the provisions of
section 8 of this Order, shall be appointed by Instructions or Warrant
under His Majesty’s Sign Manual and Signet, or by the Governor by an
Instrument under the Public Seal of the Colony in pursuance of His
Majesty’s Instructions through the Secretary of State.
7 . The Unofficial Members shall be persons not holding office of
emolument under the Crown in the Colony, and, subject to the pro
visions of section 8 of this Order, shall be appointed by Instructions or
Warrant under His Majesty’s Sign Manual and Signet, or by the
Governor, by an Instrument under the Public Seal of the Colony in
pursuance of His Majesty’s Instructions through the Secretary of State.
8—(1) Subject to the provisions of this Order, every Official or
Unofficial Member of the Council shall hold his seat in the Council during
His Majesty’s pleasure and shall in any case cease to be a Member at
the end of three years from the date of the Instrument by which he is
appointed, or at such earlier date as may be provided by such Instrument,
or previously thereto if his seat shall become vacant under the provisions
of this Order.
(2) The seat of an Official or an Unofficial Member of the Council shall
become vacant—
(a) upon his death; or
(b) if he shall, without the leave of the Governor previously obtained,
be absent from three consecutive meetings of the Council; or
(c) if, he shall by writing under his hand addressed to the Governor
resign his seat in the Council and, in the case of an Official Member,
his resignation is accepted by the Governor; or
