(a) The Coapany sliall fail tn rx.kc any of the paynents
prescrihecl in this ^yrecnent nithin 6 nonths of the date on which
they fall due, or
(h) The Company shall be in default in respect of an rrbitration
award under article 24 hereof.
• -ucTICIE 20. Nothing in this ^^preenent shall bg read as
restricting in any way the ripht of the Shaikh to prant to other
parties concessions or permits for materials other than the Substances
as defined in ijrticle 3 provided that the -perations and rights of the
Company hereunder are not thereby injuriously affected.
If the Shaikh sh, uld at any cate subsequent to the-date of
signature of this agreement grant to any other parties c.ncessions or
permits as aforesaid the Shaikh undertakes, that such concessions
shall contain provisions requiring the holders thereof to abstain from
damaging, impeding or interfering with the property, operations and
interests of the Company.
Deposits of minerals such as gold, silver, copper, lead, potash,
sulphur and salt or the like which nay be discovered by the Company
shall bo reported to the Shaikh and shall not bo worked by the
Company except under special poncessi- n or permit from the Shaikh,
Further the Company shall .instruct Geologists to nark carefully
and report to the Company any area and its location which appears
to them to give promise of yielding minerals or fresh water from a
bore-hole and the Company undertakes to keep the Shaikh informed of
all such minerals and water reports and the sites of the area or
areas.
nkTICID 21. The Shaikh hereby agrees that the Company nay
transfer the obligations and benefits of this Agreement to a British
Company to be called "Petroleum Development (Trticial Coast) Limited"
or to any other Company registered within the British Empire
ARTICLE 22. Failure on the part of the Company to fulfil any
of the conditions of t is Agreement shall not give the Shaikh any
claim against the Company or be deemed a breach of this Agreement in
so for as such failure arises from force najeure, and if thr ugh
force najeure the fulfilment by the Company of any of the conditions
of this Agreement be delayed the period of such : delay shall be added
to the periods fixed by this Agreement.
Force majeure as used in this agreement includes the ^ct of
God, war, insurrection, riot, civil commotion, tide, storm, tidal
wave, flood, lightning, explosion, fire, earthqu kes and .any other
happening winch the Company could not rea.sovu.bly prevent or control.
‘ AdTICLE 2g. The Shaikh slm.ll not by general or special -legislation
or by administrative measures or by any other act whatever annul
this Agreement except as provided in .article 19.
No alteration shall be made in the terns of this Agreement by
either the Shaildi or the Company except in tho event of the Shaikh
and the Company jointly agreeing that it is desirable in the interests
of both parties to make certain alterations deletions or additions to
thi s , .grcement.
