justify his claim on the grounds that (a) it
was already his hy prescription and (h) that if
it was not his it was res nullius and therefore
hecauie his hy the act of annexation. We felt
.however that if the Sheikh took any action to
assert his claim we might he faced with claims
either from Persia or from Saudi Arabia and
perhaps claims from hoth of them simultaneously.
It seemsd that hoth might declare that the
island had from time immemorial been visited by
their fishermen etc. and back these declarations
U-P by arguments based in the case of Ibn Saud
on propinquity and in the case of Persia on the
ground that all islands in the Persian Gulf The historical term used to describe the body of water between the Arabian Peninsula and Iran.
ought to be Persian and that Farsi at least
betrayed its Persian connexion by its name. We
therefore concluded that if there was any action
by the Sheikh to assert his claim it ought to be
on the understanding that he should realise
that if someone else with a oetter claim than his
came along we should not necessarily support his.
In the event no action was taken at the time
and the question lay dormant until recently when
it became necessary to consider the navigational
: safety measures at the western end of the Gulf
in connexion with the increase of traffic to
Koweit brought about by the development of the
oil fields there. It was accordingly decided
■ that the opportunity should be taken to give
the Sheikh a chance unobtrusively to assert his
sovereignty by giving his permission for a new
beacon to be set up at Farsi Island. Permissior
was accordingly given to the Political Resident A senior ranking political representative (equivalent to a Consul General) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Residency.
