Dear Dale,
. We have been coneiderlng with the
Commonwealth Relatione Office the Question of
aroendniente which it will be necessary to niake to
the
Persian Gulf
The historical term used to describe the body of water between the Arabian Peninsula and Iran.
Orders-in-Council t>z a result
of the Government of the United Kingdom taking
over responsibility in the Gulf from the
Govermcent of India* Some points have arisen
which concern the Colonial Office and we should
be grateful if you would give them your
consideration.
2. Article 1? of the
Trucial States
A name used by Britain from the nineteenth century to 1971 to refer to the present-day United Arab Emirates.
Order-in-
Council 1946 and the corresponding Articles in
the other Orders provide that:
M v;»here a person subject to the Order is
accused of the commission of an offence
the cognisance whereof appertains to the
Court, and it is expedient that the offence
be enquired of, tried, determined, and
punished in a British Possession, the
accused may (under the Foreign Jurisdiction
Act, 1090, section 6 ) be sent for trial
to Bombay.*
The Kind of case in which this provision might be
used is v/here a European or American is accused of
a serious offence. It would not now be appropriate
to send such persons for trial in Bombay and it is
proposed, with your agreement, to substitute some
British Possession. If you see no objection to
this proposal, we should appreciate your advice as
V.L. Dale, Esq.,
Colonial Office.
