LORD LONDONDERRY said that our recent experience
had shown that the policy of giving way to Persian demands
was entirely useless. He therefore deprecated the pro
posal to evacuate Basidu and Henjam. It would be
unwise to approach the Shah personally, as this would
be interpreted as an indication that we were anxious
to conclude a treaty. He fully agreed with the
strategic importance placed on Bahrein by Sir Samuel
Hoare. As there could be no question of our giving up
this island in any circumstances, he was averse to
referring the question of its status to the Lav/ Officerso
LORD HAILSHAM said that in his opinion the question
of our right to Bahrein should be referred to the Law
Officers. If our claim was considered to be good we
could take a firm stand. Should an adverse opinion be
received we would be aware of our weak points and might,
be able to remedy tnamo He, himself, had always
opposed the signature of the optional clause and the
conclusion of similar agreements to arbitrate on the
grounds that cases such as tnis might arise on which we
could not afford to accept an adverse verdict. He
thought it would be a good thing if the complete informa
tion on this question could be given to the Law Officers,
who should be asxed co consider tne case from every aspect.
If our position ^vas weak we could then consider what atti
tude should be adopted. International law, unlike the
ordinary municipal law, was vague ana uncertain and could
not be readily rectified by legislation. 1 There was
no statute of limitations under international -aw nor
were prescriptive rights so clearly defined. He cited the

This volume contains correspondence regarding wide-ranging negotiations that took place between the Persian Ministry of Foreign Affairs and the British Legation in Tehran, the aim of which was the agreement of a bilateral treaty between the British and Persian [Iranian] governments in order to resolve a number of outstanding issues including the status of Basidu.

Arrangement

The subject 200 (Anglo-Persian Treaty Negotiations) consists of eight volumes, IOR/L/PS/10/1250-1257. The volumes are divided into ten parts, with parts 1 and 2 comprising one volume, parts 3, 4 and 5 comprising one volume each, parts 6 and 7 comprising the fifth volume, and parts 8, 9 and 10 comprising one volume each.

The papers are arranged in approximate chronological order from the rear to the front of the volume.
