WITH reference to my telegrams Nos. 176 and 177 of the 28th July, and m
compliance with the instructions contained in your telegram No. 143 of the 26th July,
I have the honour to transmit to you herewith enclosures showing the present position
of my negotiations in connexion with articles 1 and 7 of the general treaty, with the
proposed exchange of notes regarding the visit of warships to Persian ports
(article 3) and with article 6 of the Hen jam Protocol (article 4).
2. In one respect, namely, with regard to the position of Iraq until 1932, both
the British draft and the new Persian counter-draft would appear to need revision
in the light of the recent decision of His Majesty’s Government to exclude Iraq
from the scope of the present treaty. I would suggest the incorporation of some
such declaration as forms Annex 2 of the draft commercial treaty, definitely
excluding that country from the scope of the general treaty also.
3. With regard to the text of article 3, I have the honour to state that the draft
cited in paragraph 2 of your despatch No. 340 of the 9th July on this subject is
acceptable to the Persian Government as an article in the treaty.
4. It will be observed that in the draft exchange of notes submitted herewith
for your approval Kharag Island has been enumerated among the list of places w ic i
His Majesty’s ships might desire to visit, and it was, consequently unnecessary so
to word the draft as to leave open the possibility of visits to places other than those
