Dear iiarrison.
We have been considering the points raised in your letter
No.Bxt.4)7/47 of the 1st March to Lepper about the hurma Oil
Conpany’a proposed concession wit 1 the oheikh of K owe it
covering his rights in the Neutral 2one and we think that you
may be interested to have the.opinion of our legal adviser on
this subject* It is as follows
At meetings held at the Poreign Office in 1934 'vith the
Deputy Saudi Arabian Minister for Poreign Affairs the view of
the Foreign Office was expressed tnat no part of the oil
, concession in the Neutral Eone could be separately granted lay
either of the rulers concerned, but only jointly by both rulers*
The Saudi Arabian representative agreed tiiat his Government was
not free to dispose of the concession or any part of it except
in agreement with the Sheikh of Koivait*
In fact the Saudi Arabian G-overment lias granted to the
Galifomia-Arabian Standard Oil Company a concession to the
extent of all the Government^ "right, title and interest, now
or hereafter" in the Neutral Eone and that, I thin: I am right
in saying, without reference to or the concurrence of the Sheikr
of Koweit* Possibly the views of the Poreign Office in 1934
were wrong and the Saudi Arabian Governnent did not thereby
exceed their powers under the 1922 Agreement, and T think their
action would now justify the Sheikh of Koweit in maiding a simiia
concession without reference to I bn Saud, but on the other hand
I am sure that the terms of the 1922 Agreement preclude the
concessionaire of either Government from actually exploiting its
concession without the concurrence of the other Government
