Your Excellency,
four j-etter of the 20th instant was placed before my
Board at this week's Meeting and I am requested to express
their extreme surprise at the suggestion that the Conpany
is unwilling to pay to your Government the Royalties now
xn arrear,since they and you are both well aware that we
are both willing and anxious to pay op these Royalties and
Wion this object in view have in fact had a special repre
sentative waiting in Teheran for more than 6 months en
deavouring to come to an arrangement with your Government
by failing to deal with the questions which are corollary
to ilie payment of the Royalties,are themselves alone
responsible for the delay in payment,
Xv has been suggested that we should pay up the
Royalties and ai.t.cw the other Questions to remain open for
settlement at some future time by arbitration or otherwise.
We iegret,however that we cannot agree to this course as
the counter claims which we have against your Government
viz:
(1) for the loss sustained by us in respect of the damage
done to our Pipelines by Persian tribesmen in contravention
of Article 14 of the Concession Agreement, and
(2) for the 3% Royalty which we have been compelled to pay
to the Bakhtiari Khans notwithstanding the guarantees given
in Articles 3 and 4 of the said Agreement,
