Company lor their operations. In the land so
granted the Company shall, for the period of their
agreement, enjoy full proprietary rights." I take
it that this will cover such land only belonging to
the Sheikh as is uncultivated at such period, either
now or in the future, as the company may submit an
application to him, stating that it Is needed for
their operations?
On the points enumerated above my opinion is as
follows:-
2.(a) The Company are at present operating on the•
footing of the prospecting license as extended. The
stage has not been reached at which they can have
recourse to the terms of the scheduled form of Mining
Lease to substantiate a claim to reserve land under the
agreement. The schedule at present operative is
Schedule II, not Schedule III. I see no right
conferred by Schedule II by which they can demand land,
except under Clause II for the purpose of prospecting.
There is of course nothing to prevent them from
acquiring land now by separate contract or bargain, but
they cannot claim it as a right under the mining lease
which is not in existence.
2.(b)^^This depends on the construction of the
prospecting license. Is it reasonable to say that what
the Company now proposes is within the Clause II M to
carry out such works as may be necessary for the
purpose of prospecting - "? The letter of 7th Leer,
