With reference to Foreign Office letter Ho.
E 2152/227/91 of March 17th last, relative to the proposal
to erect a lighthouse outside Jeddah harbour, I am directed
by Mr.Secretary Ramsay MacDonald to transmit to you, to be
laid before Lord Olivier, the accompanying copy of a despatch
from His Majesty’s Agent at Jeddah, together with a copy
of the Foreign Office reply thereto.
2. I am to explain that the question of the Jeddah -
Port Sudan cable (mentioned in paragraph 3 of Mr.Bullard’s
despatch) is one which, unfortunately it has proved impossible
to settle by agreement with King Hussein. This cable, insofar
as the Turkish ownership of it before the war is concerned,
is covered by the provisions of Article 111 of the Treaty of
Lausanne, under which Turkey renounces all rights and title
over all cables which no longer land on her territory. The
treaty does not, however, specifically provide for the
future ownership of such cables and technically the King of
the Hejaz might argue that under Article 60 he should succeed
to Turkish rights, Egypt and the Sudan not being ’’territories
detached from Turkey" under the Treaty of Lausanne. The
Hejaz is not, however, a party to the Treaty; and in equity,
and on analogy from Article 110, the future ownership of
the cable ought, in the view of this department, to be
equally divided between the two States on which the terminals
fall. His Majesty’s Government have hitherto consistently
