as the Governor General in Council which expression shall include
his successors and assigns) of the one part and the KGWAIT ZCB^IH
TRnHGhORT COMlidMY (hereinafter referred to as the Contractor
which expression shall include his personal representatives and
permitted assigns) of the other part. Thereas the Contractor
nas agreed to provide a motor vehicle service for transit, con
veyance and delivery (as hereinafter mentioned Kuwait-Zubair
; nil Service) of ail postal articles and mail bags as defined in
the Indian Post Office Act 1393 and Rules thereunder as amended
for the time being (hereinafter referred to as the ._ct) and the
Governor General in Council has agreed to entrust the worn to the
Contractor upon the terms and conditions hereinafter appearing.
1. During the continuance of this agreement that is to say
for the period of one year from the 1st day of -pril, 1947 unuii
this agreement shall be determined by such notice as is herein
after mentioned or otherwise in due course of law (hereinafter
referred to as the said contract period) the Contractor agrees to
duly and. safely convey between Kuwait and Zubair in either direct
ion by means or motor vehicles of good and reliable manufacture
all postal articles and mail bags as defined in the Indian Post
Office let 1898 constituting mails terminating at Kuwait and
emanating from Kuwait (and r^ules thereunder as defined for the
time being) by which the Government of India or the Director
General of Posts and Telegraphs or the Director of Posts and
Telegraphs, 8ind and Baluchis ban Circle, or the Superintendent
of Posts Offices, Lower Sind and Persian Gulf The historical term used to describe the body of water between the Arabian Peninsula and Iran. Division or the Post
master Kuwait or the Postmaster Zubair or any other person or
persons in that behalf duiy authorised shall be required to be
carried and conveyed between the said places Kuwait and Zubair
(ail hereinafter called trie said postal articles and im.ii bags).
l.(n)The Contractor shall carry part of mail Post Office
forms and stores despatched by the Postal Stock Depot or the
offices ‘where such forms and stores are printed and stored to the
various Ppst Offices Railway and Steamer stations and Railway
Kail Service offices naiaed in the schedules attached to the
agreement and such other places as may be required by the
Director of Post and Telegraphs, Karachi, and shall not claim any
extra remuneration on that account.
2. The Contractor shall during the said contract period
carry the said postal articles and mail bags, bags of forms and
stores irrespective of weight and bulk provided he shall not be
required to provide more than one complete car for each journey.
Any mail left behind will be carried the next day.
3. The said postal articles and mail bags shall be forward
ed not less than T./ICL each week from Kuwait to Zubair and vice-
versa , namely on Tuesday and Saturdays from Kuwait and on
Tuesdays and Saturdays from Zubair and the journey between Kuwait
and Zubair and vice - versa shall be performed in TLA Hours and
the postal articles and mail bags delivered in the Post Office
immediately on arrival. The timings or days of departure or
arrival of mails may be nxxx changed by trie Director, Post and
Telegraphs or the Political ^gent or the Superintendent of Post
Offices or any person authorised by them. Notice of such changes
will be given to the Contractor in time to enable him to put them
into effect.
4. During such oime as the mails are in his. actual or
constructive possession the Contractor shall exercise reasonable
care to safeguard and protect them.
5. Should any postal articles or mail bags be lost or damn
whilst in the possession of the Contractor through neglect or
ftilure on his part to exercise reasonable care he shall be
liable to pay to the Director of Posts and Telegraphs at —
