Translation of a copy of the Muzbelteh of the Dimn-i-Tumeez of the Vilayet of Baghdad,—dated
\§th Tumooz 1287.
Under telegraphic orders of His Excellency the Governor General to the
Muteseriflik, of Shahrizoo dated 22nd Suffer 1288, directing that the trial of one L
of the three brigands, Shah lliza, Persian subject, who had crossed the Persian
frontier to the places and been taken alive, should be accomplished and himself
sent here under guard; the said trial having been completed in accordance with
regulations, the Muzbetteh of the Tumeez-i-Hekook, together with the deposi
tions forming enclosure to the said Muteserif’s reply reached here, and being
referred to the Mejlis Divan-i-Tumeez with a letter from His Excellency the
Governor General, No. 217, dated 22nd Hubi-ool-awul 1288, enclosing a Muz
betteh dated 17th Rubbi-ool-aivul, has been examined.
According to the purport of the said Muzbetteh the said Shah Elza with
two other companions had been with the rebel and brigand Syud Kasim, who
during the last two years moved his residence to Persia, and every now and
then has been in the habit of crossing to this side with the Hamawund rebels
and other Persians committing murder and plundering property and conducting
himself in a shameful manner; and, while the said Shah Eiza was with them,
had on this occasion ran after a Zabtieh to plunder him, but, not being able to
catch him, have returned. On going to their own places they were pursued
by a body of Zabtieh horsemen. In the fight the said Syud Kassim was killed,
and his companion, the said Shah Eiza, wounded and taken alive. The said
Shah Eiza examined, he stated that in Persia in the District of Zohab he was
a mulazem of the Sirbaz under the command of Azeez Khan, had met the said
Syud Kasim, his relative Syud Wali and his man, Mahomed, at Panzroo in
Zohab; there he joined them and came to this side in order to commit brigand
age on the condition they would give him 60 piastres, whether or not any booty
may fall into their hands, and gave him a horse as well. He accordingly rode,
and, on coming with them to Kuratoo, a certain individual, named Mahmood,
also joined them and crossed the frontier together. On arriving to the Eohani
water in the neighbourhood of Kalkanloo they met two Arabs and took away
their donkeys and property; afterwards Syud Kasim, finding them known to
him, they returned to them their property. On this side of Kalkanloo village,
Syud Kasim and one other of his companions met a Zabtieh, and, although in
order to plunder and take away his horse and arms they pursued him, they did
not catch him. On their return they were pursued by some horsemen. In
fighting with them the said Syud fired some shots at the horsemen, but did
not hit any one; from the pistols fired by the horsemen one ball hit Syud Kasim
under the ear and he was killed. In the meantime he (Shah Eiza) also
attempted, with the gun in his hand, to threaten them and defend himself;
he w r as wounded in his hand and seized, and we understand he voluntarily
confessed.
The said Shah Eiza, because he stated here also that he is a Persian subject
and a mulazim in the Persian army, was openly examined in the presence
of the said Mirza Abool Cassini, the Dragoman, as stated in the enclosed
proces-verbal. He confirmed and declared that he crossed the frontier with the
said notoiious biigand, Syud Kasim, who was lately killed, together with
other companions, Syud Mali and Mahomed, all armed, and that, as stated
above, m the neighbouihood of the bridge of Eohani they met two Arabs wdth
four laden donkeys, and after plundering their property the said Arabs being
found to be acquainted with the brigand, Syud Kasim, the donkeys and pro
perty were returned; and then having fought with the troops who had come
out to seize them, his companion, Syud Kasim, having fired two or three pistol
shots at the troops, and he also having pointed the gun in his hand towards
the troops and told them not to go near him, if they went he would fire
at them, one of the shots fired in return by the troops hit Syud Kasim and
killed him, and he also was wounded by a ball hitting his hand, and seized.
., viewing the general facts of the case, these people have crossed this
side ot the frontier with arms, committed robbery, and fought with the troops
