3. In these circumstances, it is, in my opinion, unnecessary and
undesirable to modify the procedure recognised in the letters from the
Foreign Office of the 4th February 1904 and 12th February 1905,
quoted above, and in the letter to the Foreign Office of the 10th May
1905, which embodies the further principle that Consuls in India can
have no dealings with Native States otherwise than through the British
authorities.
4. The procedure in question makes it sufficiently clear that His
Majesty’s Government can only recognise the exercise of consular
functions at the place named in the Exequatur, which entails, as a
consequence, that the Consul must, in ordinary circumstances, reside
and transact business there. As regards the many foreign subjects
scattered throughout India outside the limits of the ports to which
Consuls are appointed, I see no objection, subject to the reservation
mentioned above concerning Native States, to Foreign Governments,
in the commissions which they issue to their Consuls, dividing British
India into such spheres for the purposes of Consular intervention on
behalf of their subjects as they may consider convenient.
