No. lolfl- 16/50. A
Political Agency An office of the East India Company and, later, of the British Raj, headed by an agent. ,
The 19th March,
Bahrain,
1945.
To
Messrs. Gray Mackenzie & Co., Ltd.,
Bahrain.
Dear Sirs,
Please refer to your letter No.L.147 dated the 11 th
March 1945 regarding Indian staff agreements.
2. Under Article 12 the empl/yee is held to forfeit his
claim to repatriation if he does not avail himself of a
passage offered to him. By this I presume is meant "repat
riation at the expense of the Company" and I shall be glad
if you will donfirm that the Company will at all times be
responsible for meeting the cost of repatriation of its
Indian employees.
3. There is no article in the memorandum of agreement
which provides for compensation in cases of disability from
injury arising out of or sustained during employment.
I.consider provision for this should be made and suggest
the inclusion of an article to read as follows:-
"Compensation will be paid in all cases of disability
from injury (Including occupational disease and death;
when the injury shall proximately cause death) arising
out of and sustained ih the course of employment and
in determining the amount of such compensation the
Company will be guided by the Workmen^ Compensation
Act in India and in no event shall the Company be
liable for the payment of compensation in excess of
that provided in said Act for a disability of the nature
suffered by employee."
The above is a replica of Article 7 of the Foreign Service
Agreement in force in the Bahrain Petroleum Company Limited.
4. You may wish to include the words "or by air" after
"by water” at the end of the first sentence of article 2 .
You also may desire to provide a more up to date means
of transport than "horse or mule”.
Yours faithfully,
Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. , Bahrain.
