Ourisdictiono Since His Majesty is responsible for defence of India
arxd since questions relating to prize jurisdiction can only arise
in the oxer else of such responsibility, we agree to conclusions
contained in paragraph I&o«,4 of your demi-official letter
NOoP* Y*1786/39, dated duly 11th, 1939, to Latimero With reference
to paragraph No *5 of same letter, we do not consider that any
reference to States is necessary^ We also agree to procedure
suggested in paragraph Noo 6 , and will instruct Staiefc accordingly,
but copies of Prize Court Rules, as amended, will be required by
Detaining Officers in the States who are already functioning in
accordance with D 9 eloin, officers 5 War Instructions (India), IS58o
Detaining Officers arc State officials appointed by the States;
Political Officers could not conveniently perform these duties,,
We leave to the Secretary of State's discretion to decide whether
jurisdiction of Indian High Courts in matters of prize
(? jurisdiction,omitted) ehovild be extended by legislation in
Parliament or by Order in Council A regulation issued by the sovereign of the United Kingdom on the advice of the Privy Council. under foreign Jurisdiction Act
