(c) In view of the modification suggested at (b) above article
11(2) (i) (a) in superfluous.
(a) In part IV of ict III of 1923 there is no reference to "fc&JL
Trovincia] Government" and hence the rule of construction in
Article 11(2)(i)(b) for that expression seems meaningless,
igain, it appears that a role of construction for "British Inhia",
with special reference to this Act, is unnecessary. Cn the other
nana, following, the usual practice in. applying British Indian
enactments to administered areas in Indian States, a few general
rules ol construction applying to all the enactments mentioned
in the Schedule to the Order would be useful. The following re
draft of iirticle 11(2) i« suggested :-
"(2) The enactments mentioned in the Schedule to this
Oruer shall, as irom tne coiimencemenit of this Order, apply to
a.11 pel sons subject to this Order, in so far as they may be
applicable, anh suo.ject to any amendments to which they are for
the time being subject in the Province of Bombay and to the
following mooifications:-
(i) All i efei ences in the said enactments to Bri tish India or
any part thereof, the Central Government and the Provincial
Government shall, except as otherwise provided in this Order,
ann except where the context otherwise recjui^es, be construed,
respectively, asiHiererces to the limits of this Order, th^
Governor General and the Political Hesident*
(ii) For the pu^oose of facilitating: the application of the said
enactments, the Political Resiaent may by oraer in writiiu ,
direct by what officers any power conferred by the said enactments
on authorities other than the Cenural Government ana the
Provincial Government shall be exercisable."
