The proposed method of obtaining the Sheikh’s
consent to oar exercising jurisdiction over the subjects
of non-Moslem Powers is to obtain his written concurrence
in the draft Order (see para. 5 of F.O. letter of
13th Jan. (P.Z. 296); para. 2 of our express letter to
the G. of I. of 10th Feby.; para. 2 of the G. of I.'s
express letter to Bushire of 24th Feby. (P.Z. 1327)).
The idea was that such written concurrence would
constitute the consent of the Sheikh provided for in Ej^2j
of the draft Order.
Now Mr. Beckett proposes that all the words
after "foreigners" in should be omitted, and that we
should make sure by the definitions that "foreigners"
means all those foreigners in respect of whom we wish the
Sheikh to consent to our exercising jurisdiction. His
consent would then be clearly obtained by his expression of
concurrence in the draft Order.
I am inclined to think that Mr. Beckett’s plan
is preferable, as there would be less risk of our being
accused afterwards of having obtained the Sheikh’s consent
to this jurisdiction without his being aware that he was
giving it.
But as the previous plan was proposed partly
with the object of lessening the risk of the Sheikh
raising objections, it will be best to consult the
G. of I. and the Resident in the Persian Gulf The historical term used to describe the body of water between the Arabian Peninsula and Iran. before
departing from it. I think that the best plan would be !j|
that, after your discussion v/ith Mr. Beckett, we should
send out to the G. of I. and to Bushire so much of his
