I am commanded by My Lords Commissioners o£ the Admiralty to forward
herewith, for the information of the Secretary of State for India m ' "the
a letter of even date which has been addressed to the foreign Othce lelatm to the
legislation necessary to give effect to the Arms Iraffic Convention, and to enquire
whether they are right in assuming that the Government of India would be asked to
take the necessary powers to give effect to Chapter HI. of the Convention which
refers to supervision on land in ilie prohibited areas.
2. A similar letter lias been sent to the Colonial Office.

Sir,
With reference to your letter No. A. 6099/1524/95 of the JOth September, 1 am
commanded by My Lords Commissioners of the Admiralty to acquaint you that they
are not clear as to the effect of the Protocol to the Arms Traffic Convention. I hey
would be glad to be informed whether it is the intention that, when the necessary
legislation has been obtained to carry out Chapter IV. of the Convention, it should be
put into force forthwith as regards the districts scheduled in Chapter 11. without
waiting for the final ratification.
2. It is to lie remembered that pending the passing of new legislation the Navy
can only take action r,o a very limited extent—that is to say, it can only take such
action in the waters of British and Italian Somaliland, Persia and Muscat, as is
covered by the Somaliland Eire Arms Begulations of 1903, and the special agreements
with the Governments of Italy, Persia and Muscat.
3. In view of Home Office letter of 11th December 1919, a copy of which was
forwarded to the Admiralty with Foreign Office letter 182390/W./50 of 16th March
1920, Their Lordships presume that steps are being taken to prevent the exportation
of arms to the districts scheduled under Chapter II. of the Convention.
4. Their Lordships also presume that the Home Office will take the necessary
action to prevent, on ratification, any exportation of arms contrary to Chapter I. of
the Convention.
5. It is thought that Chapter III., Supervision on Land, will only require local
legislation, and that the necessary action will be taken by the Colonial Office and
India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. . These Departments are, however, being asked to confirm this.

herewith, for the information of the Secretary of State for India in Council, copy of
letter which has been sent to the Treasury relative to the legislation necessary to
bring into force the Protocol to the Arms Traffic Convention.
2. I am to request that this Department may be informed of any remarks which
you may send to the Treasury in connection with para. S.

to the Foreign Office.
