With reference to foreign Office letter No.E 6593/19/34
of November 1st, forwarding a copy of instructions sent to
His Majesty's Minister at Tehran on October 31st regarding the
arbitration articles in the Treaties now under negotiation
with Persia, I am directed by Mr.Secretary Henderson to state
that he considers it desirable to send further instructions
to Sir R.Clive on this point at an early date.
2. It appears to Mr.Henderson, on further consideration,
that the signature by His Majesty's Governments in the United
Kingdom, India and the Dominions of the Optional Clause of the
Statute of the Permanent Court of International Justice has
rendered unnecessary the negotiation of an arbitration
provision in either of the Treaties at present under negotiation
with Persia. Persia has only herself to sign the Optional
Clause to obtain the arbitration agreement which she apparently
de si re s.
3. I am accordingly to transmit to you the accompanying
copy of a despatch which Mr.Henderson proposes to address to
Sir R.Clive on this subject, and to enquire whether Mr.
Secretary Benn concurs in its terms.
4. A similar letter is being sent to the Dominions Office,
and copies of this correspondence are being sent to the Board
of Trade, Colonial Office, Admiralty, Air Ministry and War Office.
