limited to certain parts of the bed of the sea than the
right to occupy unoccupied territory on dry land could be
limited to certain unoccupied territory to the exclusion
of other such territory.
4. Your memorandum also discusses the danger that
appropriation of the bed of the High Seas together with the
conduct of boring operations from abcwe might result in
some extension of territorial waters* and that oountries
whose vessels are engaged in boring operations at sea in
respect of part of the bed of the sea beneath which they
had appropriated, might tend to claim as territorial waters
the waters lying round the vessels or other permanent
artificial works employed in the boring operations. tfhile
Mr. iMen is fully in agreement with the view expressed in
the memorandum, namely that such a claim could not possibly
be admitted, he. does not feel that thore is any real danger
of such a claim being established, since the best view
appears to be that, generally speaking, artificial islands
or stationary vessels cannot be made the basis of a claim
to territorial waters round them. further, the writers
who admit the possibility ol* occupying the bed of the sea
3 bate specifically that such occupation must not be
allowed to interfere with the freedom of navigation and,
moreover, that it does not imply or involve any claim to
the occupation of part of the actual High Seas themselves.
