(h) The obligation for armed tribes who may be called up by their
Government for military purpose to take away with them their
families and animals.
(i) To examine the proposal contained in the Colonial Office tele
gram No. 25, dated thellith January, 1924,* in respect of guarantees
to be taken from tribes who have moved from one territory into the
other as a security for good behaviour, on the understanding that the
same guarantees may be taken from Nejd tribes at present settled in
‘Iraq (e.g., the Nejd-Shammar) and on the understanding that if they
refuse to produce such guarantees they may be threatened with ex
pulsion. Such guarantees will be liable to confiscation in case a tribe
or section of a tribe concerned commits a raid.
(;) The return of loot by both parties. The ‘Iraq delegation had
asked, at the Kuwait Conference, for the return of loot and the pay
ment of compensation commencing from the coronation of King
Faisal until the date of the Kuwait Conference. The Nejd delega
tion rejected this and counter-proposed that all loot taken before the
‘Uqair Conference should be ignored by both sides. After long
correspondence the ‘Iraq Government accepted to consider the ‘Uqair
Conference as the date from which the reckoning should begin. Thus
that limit was accepted by both sides. Similarly both delegations
agreed that the actual losses and loot should be ascertained by a
special committee set up for the purpose. In view of this and in
view of the fact that, owing to our want of sufficient evidence and
lists, the detailed consideration of the question of loot is impossible
at present, I therefore request that you will take whatever action
you think fit to confirm the verbal agreement which has been arrived
at, either by the insertion of a special clause in the proposed Agree
ment, or in any way you deem fit.
(k) I ought to add for your consideration that the tribunal which it
has been suggested should be set up to consider the question of loot
taken since the ‘Uqair Conference is not the same as the tribunal
which ought to be set up to enquire into raids and loot taking place
after the present Conference at Bahra and to fix the responsibilities
in the future. On the other hand, if any difficulty is found in setting
up. a separate committee and tribunal simultaneously, there is no
obje< tion to giving the proposed tribunal the power of enquiring into
the previous losses as well as future losses ; that is to say to enquire
mto post-'Uqair as well as post-Bahra losses. Respects.
