I enclose an extract from a note which has been com
piled by the Indian Assistant from which you will see that
Mohamed Noor bin Abdul Ghafoor nas sued in the Agency An office of the East India Company and, later, of the British Raj, headed by an agent. and
Joint Courts as a foreigner between the years 1931 and 1937.
I am informed that cases 2 to 7 noted on the enclosure were
decided by the Joint Court.
It would thus appear that the individual concerned has
up till the present time been considered as a foreigner and
as such subject to the jurisdiction of this Agency An office of the East India Company and, later, of the British Raj, headed by an agent. . From the
fact that certain of his cases were tried by the Joint Court
it is reasonable to assume that the Bahrain Government
acquiesced in the view that he was not a subject of His Highness
the Shaikh. This being so it is difficult to agree that the
decision of His Highness 1 Court in the recent case should stand
as it would appear to me that unless the individual concerned
has recently acquired Bahrain nationality the Bahrain Courts
were acting ultra vires.
3. That Mohamed Noor bin Abdul Ghafoor was aware that he
should have applied for the transfer of his case to the Agency An office of the East India Company and, later, of the British Raj, headed by an agent.
Courts is probable although it is possible that be may have
conceived the idea that suits of that particular natare were
only triable by the Bahrain Courts.
4. I shall be very glad if you can consider this question
again as although I have not the least desire to disturb the
working of the Bahrain Courts I cannot but uphold the view that
as they did not appear to have had jurisdiction then their
decision cannot be considered to be •

The cases raised include property theft (folios 26-29), disputes over land ownership (folio 59), inheritance (folios 13-19), accidential death (folio 48), and liability for the dangerous condition of roads (folios 33-34).
