Act V. of 1861 was passed with the intention of making it applicable to all parts of
India.
It was proposed to introduce it into this
Presidency

, but Sir George Clerk’s Govern
ment objected to it, and it is now proposed to introduce such parts of it as are applicable
to this part of the country in which the Village Police exists, whose status was not to
be affected by the General Police Act.
The vast size of the Zillahs or Districts on this side of India, as compared with
those in Bengal and the North-West Provinces, prevented the introduction of the whole
of iggi, and were the size of the Zillahs or Districts reduced, the expense that
would be incurred would not justify the change. It is therefore proposed to consolidate
certain portions of former Police Regulations, and to enact parts of Act V. of 1861 with
such modifications as will make it applicable to our large Zillahs and V illage Police, and
to repeal and re-enact the provisions of Chapter VI. Regulation XII. a.d. 1827, pro
viding for the Village Police in such a form as to adapt it to the Act for regulating
District Police.

makes it desirable that the powers
conferred by the Code of Criminal Procedure on the Magistrate and Subordinate Magis
trate of the first class should in certain cases be exercised by any Magistrate.
The object of the first Section of the accompanying Bill is therefore to authorise the
Magistrate to depute to any Subordinate Magistrate the power to try certain offences
punishable under the Indian Penal Code.
The second Section of the Bill is proposed at the recommendation of the Judges of
the late Sudder Adawlut, who considered it very desirable that District Police Officers
should be empowered to deal with the petty cases of nuisance mentioned in the Sections
of the Indian Penal Code referred to, the work imposed on the Assistant Magistrates by
the introduction of the Criminal Procedure and Indian Penal Codes being much increased.
This Bill is still under the consideration of the Council of the Governor of
