APPENDIX TO JUDICIAL REPORT.
7th. (C In the allowance and disallowance of this right, Judg'es can only act
now by analogy, which is unsatisfactory, and must almost necessarily lead to a

To carry out as far as possible the recommendation of the Honorable Judges
contained in paragraph 3 of their reply, a rlbtification was published in the Bombay
Government Gazette of the 3rd July 1862, declaring that in accordance with the provi
sions of Section LV. of Act XVIII. of 1862, the said Act was to take effect in Her
Majesty’s Supreme Court of Judicature in Bombay on and after the 3rd day of July 1862.
This Bill provides for carrying out the other recommendations made by the Judges
of Her Majesty’s Supreme Court.
It was passed by the Bombay Council, but was rejected by the Viceroy. It was,
however, passed by the Council of the Governor General with few verbal alterations.
