Tikamdas Dharamdas was a second class passenger
on hoard s.s."Bandra H which arrived from Bahrein on the
14th February 1935. While examining his baggage the
Customs Preventive Officers found 200 Persian silver coins
and some silver bars wrapped up in cloth in seven separate
parcels concealed in an attache case.The usight of the
silver coins and bars was 378 Troy os. In addition, a
piece of silk cloth measuring 32 yds was also found on his
bunm. none of these dutiable articles had been declared by
him in his baggage declaration.Subsequently when
questioned by a customs Officer as to whether he had in
his baggage any silver or other dutiable articles he
replied in the negative.
2. The circumstances of the case clearly point to the
conclusion that the passenger,Tikamdas,made a deliberate
attempt to defraud the customs revenue firstly by not
declaring the silver bars,coins and the piece of silk
cloth which he had with him and secondly by having the
silver pieces wrapped up in small parcels ready in an
attache case to facilitate their being passed to his friend
who came to receive him on board the steamerr Ee has
thereby committed offences punishable under clauses 40 and
73 of section 167, sea customs Act.The duty involved in
this case is Bs 187/a/-.
3. The silver coins,silver bars and the piece of silk
cloth are confiscated under the penal clauses cited above.
They may,however,be redeemed on payment of a redemption
