The Persians, in the course of the present
negotiations, have consistently pressed for the
inclusion in the General Treaty of arbitration
provisions. The draft article vhich His Majesty's
Government were prepared to offer, together with the
Minister of Court's criticism of it, are flagged "A"
at the bottom of the file. It will be seen that
Taimourtache is anxious considerably to extend the
scope of the arbitration provisions.
On the. 31st October, the Foreigi Office
instructed Sir Robert Clive that the signature of the
Optional Clause had necessitated a review of the
vhole future policy of His Majesty's Government on the
subject of the conclusion of bilateral treaties of
arbitration, and that, pending a decision on the
general question - which mi^it take a considerable
time - they were unable to consider the Minister of
Court's counter-proposals (despatch to Tehran No. 526,
of 31st October, 1929 - p. 70 18/29). From their letter
of the 18th March, it will be seen that they are now of
opinion that we should inform the Persians that
sigiatare of the Optional Clause by His Majesty’s
Government has rendered unnecessary the negotiation of
an arbitration provision in either the General or the
Commercial Treaty, and that Persia has only herself to
sign the Optional Clause to obtain the arbitration
agreement which she apparently desires.
From the advance copy of Tehran telegram No.
64 of 19th March below, it will be seen that the
question was discussed between Sir Robert Clive and
! Taimourtache at their meeting on the 18th March, and
th^t the Minister, ”as a personal opinion", after
