8. Taking the different grades of civil courts separately, it appears
that in the lowest grade (the Moonsiff Courts) 201,496 cases were on the files
for more or less of the year, of which 166,807 were disposed of. The Sudder
Ameens disposed of 20,955 out of a total of 24,926 ; 181,117 of the total
being suits instituted in the preceding year. The Principal Sudder Ameens
presiding in the court of appeal disposed of 11,902 original cases, and four
cases of appeals out of a total of 16,696. The court lately called the Sudder
Dewanee Adawlut, now the appellate side of Her Majesty’s High Court of
Judicature, disposed of 7 regular cases and 501 special. Taking all these
courts together, the number of suits left depending by them on the close of
the year was 47,053. The average duration of suits in all but the highest
court ranged between five and seven months. In the late Sudder Dewanee
Adawlut, the present High Court, the average duration was one year and
eighteen days; but in reference to the calculation of these averages, the
following quotation may be made from a letter (252 of 1863) written by
the Judge of the Concan District, and accompanying the returns from his
court. Mr. Justice Tucker states that the statement in the returns which
professes to be a return of the average duration of suits “ gives no correct
representation of the real state of business in any court. The average is
calculated on the whole number of decided cases instead of on the whole
number decided and depending, and the consequence is that when old cases
have been postponed and recent ones disposed of (which under the present
system often happens), a far too favourable picture is given of the efficiency
of the Court. I pointed this out nearly ten years ago, but the Judges of
the Sudder Adawlut of that time decided that the method of calculation
which is now in use was correct.” With this may appear what the same
Judge in another part of the same letter writes of the subordinate Judges
